Personally I would want the faster speed (i.e. 40mb) and I suspect that a few polite calls to various managers may be in order to get this addressed and dealt with.

You may wish to consider contacting the Executive Team if you feel that you are being stonewalled by Sky. Sky should have the ability to get BTO out to change the cabling from aluminium or aluminium coated copper to copper cable.
Hi scubbie, had this discussion with sky fibre, they agreed I could get out of the contract, offered me half price line rental for a year. They asked BTO if they would resolve the problem, they wouldn't on the basis of cost.
how would I contact the executive team to progress this?
Thanks for your help by the way.

Send an email to Jeremy Darroch:
jeremy dot darroch at bskyb dot com

The email won't actually be handled by Mr Darroch, but it will receive suitable attention.

Explain clearly & briefly what has happened and what you would like to have done in order to complete this.

It might be useful to ask if this is going to be the same story with any ISP. If this is the case, how would this reflect upon the EU Government's target to have everyone able to get a connection greater that 30mb d/l by 2020 if BTO are refusing on a cost basis to all you the opportunity to get a 30+mb connection now, despite their systems predicting that you should be able to achieve 37mb already.

Word it better than I have above, but hopefully you get the idea.

I know that many people would be able to get FTTP by 2020, but IMHO it may be worth asking the questions now.

      PlusNet Fibre since Jan 2021

One thing to consider is the speed you get with ADSL. If the poor quality wire is effecting Fibre it will effect ADSL to, or were you getting a good speed with ADSL?

Then it is up to you if you are willing to pay more for 3 times the speed and I would say that there is a good chance you have been fobbed off and your low speed is for the same reason many others are experiencing, which no one seems to know the reason.
