I'm sorry I just don't believe that two business competitors have to do anything to make life easier for each other; for the customers, yes they should, but not each other.

Did Sky used it size and power to get what it wants? Yes of course! Who wouldn't?

Do I honestly think Sky played dirty? Yes of course I do, but you have to admit that Virgin made it easy for them to do it.

Oh, by the way, I don't watch sky television or much of any other TV for that matter, so I don't particularly care what they do to each other.

This is what I love about forums, everyone has thier own opinion.

I really could not care either way who is right to be honest. But Sky asked a price Virgin felt rightly or wrongly was unreasonable. Virgin refused to pay. Where is the illigality? It is simple economics if it is not worth the asking price do not buy it! Do not go crying and say I want it but cheaper.

Who ever wins this petty squable be sure of one thing, it is us the customers who will ultmately pay more on both sides to cover those expensive legal bills.

I for one do not welcome our dominant position abusing overlords.

Cant believe anyone would defend monopolistic price fixing. The UK Competition Act was passed for a reason but it seems the recent view here is that this particular law should be ignored??

Surely it cant apply to Sky?? They're fantastic....and anyone who says otherwise should be the subject of ridicule. Stupid virgin babies.

But surely Virgin are free to choose not to carry the sky channels?

Some channels have to be carried by all operators IIRC. Probably just terrestrial ones though.

Anyway, here's a bit from the Competition Act
      18. - (1) Subject to section 19, any conduct on the part of one or more undertakings which amounts to the abuse of a dominant position in a market is prohibited if it may affect trade within the United Kingdom.

      (2) Conduct may, in particular, constitute such an abuse if it consists in-

      (a) directly or indirectly imposing unfair purchase or selling prices or other unfair trading conditions;
Of course the law is an ass but on the face of it it seems pretty cut and dried.

I would say thats a fairly unrealistic comment to make.

Sky pulled off a better deal, it ain't about them being fantastic, as for riduculing Virgin Media, they made themselves out to be amateurs in the negotiation stakes, imho. It's just called having a differing viewpoint to yours.

Depends who thinks its an unfair purchase price. Obviously Virgin do.

Re: Virgin TV in BSkyB court action

Even if we assume that Virgin are a bunch of amateurs (and to tar an entire company with that kind of broad brush comment is .........) then how in the face of the above legislation would that excuse Sky for :-

Sky demanded a price for its basic channels that was some 17 times greater than it was prepared to pay for the Virgin Media TV channels, even after adjusting for the Sky basic channels' marginally higher share of total viewership.
Specifically, and assuming that the figure of '17 times' is anywhere close to being real (which they'd be insane to invent under the circumstances), how could any reasonable person claim even for a moment that this was not unfair? I dare you to claim so ;-P

      Therefore...

      If

      a. Sky are dominant in the market (which they are)
      b. It was an unfair offer (which it was)

      then what follows is :-

      c. It was illegal

      QED

So whinging and then calling Sky News - Sky Snooze etc was professional?

Thats the sort of things I would have done when I was about 6. Or set my Dad on them

Lets face, it, if Sky One etc was not so significant and worth the money, why are we hearing that so many subscribers to VM are leaving to go to Sky?

The going rate was X amount, a GOOD negotiator would have got that down easily by doing a DEAL. Sky did their deal, VM messed theirs up.

We will see who wins after the Court ruling. But I just feel it ain't such an open and shut case. If I am wrong I will send you a beer
