If all you are doing is playing on Xbox, I doubt you would use 40gb of data transfer, also there is no record of anyone having any action taken against them if they exceed the caps.

Your contract does not allow you to downgrade within 12 months, only one person has reported that he managed to downgrade without penalty.

There isnt NO set price, However ref;
