Re: What's the point in having copyright?

See the host is on the ball and treats copyright seriously. 5 hours to reply and then I get this:

I write further to your email sent today.

I can confirm we have forwarded your complaint to our client and have
requested the removal of the material in question. Should our client
fail to respond within three working days we will take action to remove
      the material.

      Yours sincerely,

      Their terms quite rightly say:

      "Intellectual Property Rights"
any and all patents, trade marks, service marks, copyright, moral rights, rights in design, know-how, confidential information and all or any other intellectual or industrial property rights whether or not registered or capable of registration and whether subsisting in the United Kingdom or any other part of the world together with all or any goodwill relating to the same

5.2 The Client aggress that it shall not:

      * 5.2.1 use the Services, Ancillary Systems and/or Client System or
allow them to be used for any unlawful purpose or for the publication,
linking to, issue or display of any unlawful material (including any pirated
software or any material which is obscene, pornographic, threatening,
malicious, harmful, abusive, defamatory or which breaches the rights
including Intellectual Property Rights of any third party or which is or
encourages criminal acts or contains any virus, worm, trojan horse or other
harmful code) whether under English law or regulation, the laws or
regulations of the Client's country or any other place where the results of
      such purpose or the material in question can be accessed;

      http://www.webfusion.co.uk/terms/webfusion.php

So I guess Webfusion are more than happy to allow this for at least the next 3 days.

You don't seem very happy with their response?

But, he must be given time to respond. His host doesn't know yet that they are not in the middle of some dispute.

Three days seems quite short to me. It took the eBay jerk more time than that to repond to me!

Re: What's the point in having copyright?

If it was a copy of XP or Vista available to download, I doubt the host would wait 3 days then. Its exactly the same scenario.

Both software and copyrighted material theft are the same thing.

The least the host could have done is suspend the hosting, until such time that its clear of any infringement.

Re: What's the point in having copyright?

Unlike MicroSoft, you're an unknown quantity to them and they need to give their client time to respond.
How would you have liked it if the situation were reversed. Him claiming copyright against you and your host suspended your hosting without first giving you a chance to respond?

      Patience my friend, patience!

Yes... I guess you are correct. I was just furious when I saw it.

And every right to be too!

I was when I spotted my dog's picture on eBay. If he'd been in York, I would have been banging on his front door demanding action!

Maybe watermarking the pictures could prevent this sort of theft in future. At the very least viewers would know that the article had been 'borrowed' from another site.
