      Comet have decided to welch on my Xbox 360 repair.

      As posted before my Xbox died just beofre Xmas and as I paid for 5 year "total product" cover from Comet I took it back to get it fixed.

      I just have had a phone call back after 10 days that the Comet insurance people refuse to sign off on it as they won't cover the DVD drive, all that they are prepeared to cover is the Hard Drive unit, hardly "total" cover.

      After being pushed from pillar to post I got through to head office where I was told "tough luck" and when I asked what the address of their legal department as for 30 I think I have a fairly strong case? I was told initially that they were "in the right" and when I said if I show a magistarites court 2 receipts with total product cover and no exemptions cavetats etc who do you think you would win?
      All I got was that "Comet doesn't have a legal department" and was hung up on.

      So now I am off to pick up my broken Xbox up from the Comet store and I shall never shop there again, considering I have had over 2000 of goods off of them in the last 3 years I think they may in the end regret doing that in the long run.

      Also I am considering taking them to court for the cost of the total product cover as it doesn't do what it promised and I rhink that I shall send it to their CEO if they don't have a legal department.

      This is the main problem buying cover from high street stores.

      You should not pick up the xbox, leave it with the store, I know it may sound silly but this way they can not say the damage happened afterwords.

      I know it sounds silly but check the cover policy, that nothing is not covered.

      And find out who the cover is run by, it may not be comet themselves. If you are sure that there is nothing in the policy that would stop it being repaired, contact trading standards, it is amazing what a phone call from them to a store will do.

      How old is the xbox?

      What you don't say is how old the X Box was, even if it was more than 12 months, under recent sale of goods legislation, it should last a reasonable period of time, I would guess at least 2 years.

      I would suggest that you write a detailed letter to their head office, pointing this out, and also to the Insurers (It is unlikely to be Comet) Before writing to the insurers, I would urge you to read the policy document carefully, to see if DVD Drives are excluded. I cannot logically see that this is the case, without the DVD drive, the X Box is useless, therefore what is the point of the cover. If it is not spefically excluded, it must be considered as included, and you should copy your letter to the insurers to the ABI or if the are members the Insurance Ombudsman Unit, the policy will have details.

      Re Court action, it is in the fact the small claims court you need (nearerst to you is Hitchin County Court) your claim is either for the cost of the insurance, or if it is covered the cost of repair, you will need an estimate for this. Have you considered local/national consumer assistance shows? 3CR have a good show, which used to get results. (I haven't heard it for a couple of years).

      I don't know what it is like in your area, but in Scotland, the Judge in the Scottish Sunday Mail is very good at solving this type of problem.

      The Xbox is 3 years old and now Comet claim that the cover was only to cover the hard drive, I had no paperwork from them, when I phoned I got a policy number and a "we'll send it to you" response.

      A letter to the CEO has already gone as the head office is in Rickmansworth.

      And as I said before that's the last money they have seen from me.

      A warning to anyone who has or intends taking out an 'extended warranty'. These are just an excuse to take money under false pretences. If you feel it is needed, most reputable insurance companies have policies to cover breakdown of household items.

      I would have been quite happy for it to have gone back to Microsoft for a repair, but the shop staff have been great just the higher ups who are stalling.

      Oh well there is always the January comp.

      I bought a DVD player from Comet ages ago and they tried selling me the insurance, and clearly told me, that they would replace it and not repair it, if I took the insurance out.

      Keep on at them, they'll give in.
