Technically, yes you are, because you are no longer using Sky's router (as it was intended)

The firmware is designed to be upgraded from one of its three times daily dial out to Sky's servers. If you change to the Netgear firmware, this will no longer happen.

and there is no-way for sky to tell anyway
Yes, there is, because the router will no longer be reporting home 3 times daily.

Re: Will I be breaching the terms and conditions?

yes it will as the firmware is written for Sky by Netgear - any change to the firmware can lead to your BB account being terminated. Just so you know.

Basically, if you flash it it will (probably) remove the sky test option (which is used in troubleshooting). If you can't get this then Sky will refuse you tech support...

Re: Will I be breaching the terms and conditions?

      Thanks for your advice guys.

I think I'll stay with the firmware I got at the moment.

Not worth risking getting terminated or anything.

      Regards.

Re: Will I be breaching the terms and conditions?

I did mine knowing it was against there T&C's but it didn't fix any of my problems. They turned out to be elsewhere so I flashed it back to Sky firmware.

Re: Will I be breaching the terms and conditions?

I'm gonna stick with the Netgear firmware. As my stats below show the netgear firmware is much more Reliable than the sky firmware.
