      ACS Law and Some Sky Broadband Customers - A Heads Up

      Have you been accused of illegal downloading by ACS Law and you are on Sky Broadband?

      If so, it may be prudent, if you have submitted any credit or debit card details to ACS Law, to cancel your card by ringing your bank asap judging by what has unfolded over the weekend. Your bank should then send you a replacement card.

      The ACS:Law web site was taken down by a denial of service (DDoS) attack earlier in the week, an event described by boss Andrew Crossley as "typical rubbish from pirates". He's likely to have changed his tune now because someone discovered that before the site was restored a backup file containing the emails had been left in an open directory. Inevitably this was downloaded and widely distributed on file sharing networks.

      More seriously there is discussion about how they could "scare" people into paying by pursuing them directly, and allegedly an email with attached file containing the names and addresses of thousands of Sky broadband users (plus the names of pornographic movies they're supposed to have downloaded) which if true constitutes a serious breach of the data protection act.

      We would like to point out, that there is absolutely no suggestion that Sky have had anything to do with this data protection leak, or indeed that Sky have been negligent. All that Sky could be accused of is, complying to a court order and then handing over the details as per the court order. It is ACS Law that would appear to have left all these details (approx 350mb of data) openly accessible on their website, although we do not have all the facts to support that ACS Law have done so.

      We have emailed Sky to see if they have anything to add to this.

      so does this affect all customers or just a few the 11000

      The 11k is not a definite figure, but one would assume, it would only contain the details of those that have been caught / wrongfully accused of file sharing.

      I think, it is the list of IPs and Names and address details of those people accused of / evidence of offence, righlty or wrongly, that Sky would have been ordered to give to ACS Law, by the courts from recent court orders.

      There is nothing to suggest that it is anything more than that, at this stage.

      One thing is for sure, ACS Law are in for the high jump. Karma is such a bitch.

      I'm reading various articles around the net about this. One thing seems common; ISPs are RELUCTANTLY handing over data, since there is no real legal precedent for NOT doing so.

      Copyright needs to be guarded, but this company seems to be more interested in making money for itself, rather than capturing duties owed to the copyright holder. As such, they are now going to be in a heap of trouble.

      I'm also vaguely amused by the snippits of letters that people have unearthed with such gems from ACS as:

      "!It is with regret that we note that the letter you have provided is an exact replica of a template available on the internet. This template response provides no individual insight to your client whatsoever and is of no value at all. "

      ...which is odd, considering *their* letters are all templates and exact replicas.

      I can see this going absolutely ballistic over the next couple of days.

      This made me laugh. I found this on the internet, no doubt we will get a cease and decist letter. How two faced is that?

      I can see this going absolutely ballistic over the next couple of days.
      Whilst I disagree with illegal downloading, their method is so wrong of ambulance chasing people and practically scaring people into paying.

      I hope (and it certainly looks like it will) the crap will hit the fan tomorrow for a certain solicitor, he deserves to lose absolutely everything for this. I hope he gets fined by the chocolate fireguard department, aka ICO - rather than being invited for tea and muffins.
