      Just to clear a few points here

      An earlier post mentioned that the suits would need to put up a torrent and allow people to download it to get the ip's and mentioned entrapment. Entrapment is NOT an available defence under UK law.

      Secondly all this i wanted to make a back up is not a defence either as under UK copyright laws you only own the right to the material that you purchased. You buy a cd and then want an mp 3 copy, legally you need to buy an mp3 copy. Making a back up is illegal. This is slightly different from the US where making a back up is actually allowed.

      Consultations are ongoing concerning the copying of CDs for personal use. This extract from Lord Triesman's report.
      It is proposed to create a new exception that
      would allow consumers to make a copy of a work
      they legally own, so that they can make the work
      accessible in another format for playback on a
      device in their lawful possession. The exception
      would only apply to personal or private use.
      The owner would not be permitted to sell, loan
      or give away the copy or share it more widely
      (for example in a fi le sharing system or on the
      internet). Multiple copying would not be allowed.

      Interesting, having a quick read to see this could also cover dvd and bluray, not just cd's which is a step further then I thought they would go, so fair play so far - now time to see what the IPO respond with.

      Oh, btw it's not Triesman's report as he is now with the FA now - and was only signed off by him as minister, it's an IPO report...

      How can they tell what were downloading, They can't judge by looking at our bandwidth usage, because some of us like to download, Like me, I'm a hardcore gamer, Lots and lots of patches for these games come out, some of them 1GB+ and they would probably suspect I'm downloading something illegal? Because at the moment, I'm downloading a perfectly legal Linux Distro which is 1GB+, Do they really know what were downloading, Or are they just guessing?

      I think the point is the Internet Police would have to establish that someone is downloading an illegal file, before they could forward the IP address to the ISP for action. Simply downloading a torrent should not trigger any action, if it does, then the system has failed.

      Ah, but how would one establish if, or if not, the file thats being downloaded is then being downloaded illegally?

      With no DPI on the ISP side (and it would have to be via the ISP's platform) how then could this be possible?

      As far as torrents are concerned all the BPI needs to do is look at the IP of who is downloading an illegal file. I don't think they can do this with P2P, but I don't know enough about the protocol to say.

      but how would they do this on torrents? Unless the BPI were feeding it into the system, and downloading it themselves to then see what IP's are taking the files or giving them. But this in turn could be classed as entrapment or taking part in illegal file sharing themselves.

      I don't know Tom, if they have ownership of the file they can easily put it up and also download material they own even if it was put up illegally. I think the old entrapment excuse only applies to US not UK.

      I was under the impression that law was applicable in the UK also.

      The same as your innocent till proven guilty (although they are making good moves to have you guilty unless you can prove otherwise).
