      I think that you would be able to flash it yourself. If of course Sky do give an image to download.

      i was under the impression that by flashing your router you would be breaking skys T&C's ?

      think i may have confused myself on this one

      is this the right sort of thing ?
      if sky were to roll out the FW by leaving it to be downloaded (like from there website) and then say, sent an email to all customers saying the update was available with instructions on how to do it, you could then upgrade ?

      You must not connect the Sky Network to insecure machines or services able to be exploited by others to carry out actions which constitute a breach of this AUP.
      Because the V1 router itself is insecure, technically speaking, you're not actually allowed to plug it into a Sky Broadband enabled phone line, even if it has the official Sky firmware.

      Technically that would apply to anything and everything that exists in networking. The most secure anything is that which is not connected to a network.

      I do believe the spirit of the meaning is that insecure machines (i.e. PCs) or services (i.e. botnet clients) are the defining words. I certainly would not take it to mean Sky's own equipment.
