I don't think so BT will still be the wholesaler, which is what Sky require, unless you have a completely new phone line. In which case your BB would not work at all.

(ii) the telephone line you use to access Sky Broadband must be a BT compatible fixed and operational line to your Address (“your Line”).
BT compatible is the operative phrase, so I think you have, and her, if she says anything is wrong. If it were, those who pay their phone rental to Sky, and many do, would not be eligible for Sky Broadband.

Before you try to get a cap lifted you should try to get S'ern to fix the crackle on your line. If Sky lift the cap before the fault is fixed, it will just drop out and give other problems.

The biggest problem will be a very unstable line, you could lose connection very often evrey minute or so or maybe even worse, nobody can predict it.

I doubt you will convince Sky to remove cap in these circumstances as you would be just making more problems for them to deal with.

Until you push your line provider to come out your best option is to do nothing

Tell them to organise a call to fix the error on your line and that you will accept the call out charge if they can prove there is nothing wrong, if they are not happy with this advise them that you are going to make a complaint with Trading Standards as they are not providing you with a service that you are paying for and that you will have no option but to leave.

If you are still in contract, they have breached it by refusing to supply you with a good working noise free connection. You may also wish to exaggerate the amount of crackle and advise them that at times you can not hear the caller on the other end.

You need to get a pair and stop taking their Bullpoo
