      Question Sky BB - Abuse address

      Does anyone have abuse eMail address for Sky?

      (It about another sky Broadband User making defamatory comments)

      No offence, but if the abuse took place on this forum, which you imply, then it is nothing to do with Sky. You should address your complaint to the Mods team.

      It has nothing to do with this website. Its on Usenet, but the user has a Sky Broadband email address and the IP traces back to Sky BB,

      depending what it is, i doubt Sky can do anything about it. freedom of speech and the like....you're better off alerting the Usenet mods as they can ban said user

      Most of Usenet is unmoderated, so that's not likely to be an option.

      On the other hand, Sky's T&C's state (note the second item in the list):
      You may not use Sky Broadband and/or the Sky Network to send, receive, store, distribute, transmit, post, upload or download any materials or data which:
      • violates any Law;
      • is defamatory, offensive, abusive, indecent, obscene, or constitutes harassment;
      • is in breach of any third party rights (including any third party intellectual property rights);
      • has any fraudulent purpose or effect; or
      • damages or may damage our name and/or reputation.
      Sky can generally claim a "common carrier" defence in cases of defamation, etc., unless they have received a complaint, in which case the "common carrier" defence is generally no longer available to them. This is a point of law that was established in the Godfrey vs Demon Internet Ltd case. As a result, if they fail to act in response to such a complaint then they risk being sued, so I would imagine they'd be keen to at least warn any customer engaging in activites which violate the terms and conditions, if not terminate their contract entirely.

      The right to free speech does not place an obligation on any organisation or person to broadcast, relay or print that speech.

      IT is defamatory which breaks the AUP, so I have every right to make a complaint. Also reading in there the user could loose their Broadband Account. Is this correct?

      I think the most likely thing that Sky would do is warn the user in the first instance, and draw their attention to the terms and conditions of their account. And then if they continued to post defamatory messages using their Sky account, and Sky received another complaint about them from you, then they're likely to close the account. But I suppose it depends on just how bad the defamation is. I wouldn't ask you to repeat what they wrote here, of course.

      Have you received a reply from abuse@sky.com? Have they said what action they intend to take? (It might take a few days to receive anything other than an automated response.)
