My 12 months is up - ive cancelled , but SKY want the router back!!?

So after 12 months of service dropouts and 12 months of the most substandard customer service known to man I have cancelled SKY BB and have returned to Demon (yes it was that bad)

This morning I recieved a letter saying 'we are sorry you are leaving' blah blah blah but they have also requested I send the router back in the pre paid envelope that was provided when it was delivered (there was no envelope!)

Now if they send me one of these pre-paid envelopes in theory I have no problem with this, the router has been sitting in its box for the last 50 weeks after i swopped it for my old superior Linksys router . However i just think its a bit of a cheek considering when you sign up part of the offer is 'FREE' router!!!

Just wondering what anyones elses thoughts are on this and if anyone else has sent the router back after cancellation ?

Ive a good mind to keep it out of spite cosndiering the crappy service i have had this past year.

      He says pettily....

      From Skys t&c's
      Section 3c

"Your Broadband Box (except the software in it) will become your property on installation
if you choose Home Installation, or on delivery if you choose Self Install. The software
in your Broadband Box is owned by or licensed to SHS or another member of the
British Sky Broadcasting group. You must allow this software to be updated. Updates
will happen automatically at no extra charge."

From the above I would say they are out of order. Send them the cd back as that has a backup copy of the software in the router - lol

They can't ask for it back. As Dholdi has stated the T and C's it is your property. Just send the disc back.

Re: My 12 months is up - ive cancelled , but SKY want the router back!!?

Interesting. I wonder what the legal situation is? Sky state quite clearly that the router becomes your property, but the software on it remains their property. They could demand the return of the software on the router, but how you do this without returning the router, which is your property, is beyond me. I don't think the software on the CD counts, as it is not mentioned in the T & Cs. A bit of a catch 22

I have not seen this mentioned when others left.

Re: My 12 months is up - ive cancelled , but SKY want the router back!!?

I suppose but strict interpretation of the t+c's would suggest that the router has to be returned so the software could be removed.
After that the situation is less clear.

There may well be a case for it to be returned. An opposing viewpoint may be that they come and collect it as the ex-user has neither the time, the inclination or otherwise to package it up and take it to the post office.

Send them a letter saying you will make it available for collection in the hours you are normally at home. The ball is then well and truly in their court.
They either collect it or they don't. They probably wont as the cost factor will far outweigh the units worth.
You will have shown reasonableness by making it available for collection so on that basis no court in the land can accuse you of being in contravention.

Re: My 12 months is up - ive cancelled , but SKY want the router back!!?

Like i said im not really arsed - they can have the thing back.

What narks is me is that they firstly offer you a router as FREE, then provide an awful BB service, then ask me to send it back in a pre-paid envelope which i never got!!

I like the iea of the above poster. I will pop them an email saying its up to you to come and collect it.

      Which i think is fair.

Will let you know how i get on.

I think it may be better to point out that according to the T &Cs, the router is yours, but you would be prepared to allow a Sky representative access to remove their software, provided the router was returned to you in a working condition.

Another idea - as you are no longer a sky subscriber, flash the router to netgears latest version of software - thus removing skys software and include a screenshot of the router homepage, which shows the software version, with your email saying they can collect it. If they do bother to send someone to collect - just give them the cd as that is the only version of their software you have.
