I swear I am no relation to Ken Murdoch.
The law is the law BUT you are innocent untill proven guilty.

"Pirate Bay makes no secret of the fact that it inserts the random IP addresses of users, some of who may not even know what file sharing is, to the list of people downloading files, leading investigators up a virtual garden path."

BBC NEWS | Technology | Games firms 'catching' non-gamers

"According to Michael Coyle, an intellectual property solicitor with law firm Lawdit, more and more people are being wrongly identified as file-sharers.

He is pursuing 70 cases of people who claim to be wrongly accused of piracy and has spoken to "hundreds" of others, he told the BBC.

Its a minefield really, there are even programs which can be run while using torrents etc which prevent organisations from monitoring what you are doing. Its a shame but there would be no point in jumping ship, all ISPs are doing this now as far as I know. Whats the point in the fast broadband speeds?

It makes it faster to download legal content.

Re: has anybody had a letter yet ?

Downloading trackers is not anonymous, the tracker has your IP, so for instance say I was downloading a game say GTA IV, I loaded my torrent and its downloading, I will have a list of all the people that I am connected to which I am downloading parts of the file. Now those people are uploading or sharing the file with me. So if the BPI was to create a torrent and then seed it and look at all the people that were downloading it and the uploading as well, then it would be fairly clear to see file shares and time would just be noted down.
I am not so sure on how Newsgroup downloads work, but its likely to be a similar way.

Something to maybe note is the fact that Rapidshare have issued a statement saying that they will never looking into what files a being uploaded to their servers but will remove them if they contain illegal content, no mention on passing details on though about who uploaded it. The way to go for File Sharers maybe?

I`d be very very careful if you're downloading copyrighted content via torrents. The crackdown has begun. Stick to legal content and you'll be fine. The solicitors are rubbing their hands as we speak!!!

That is the idea behind that portion of the Act which deals with illegal downloading.

It is unlikely to have much effect on hardcore downloaders, as other ways will be found. It is now absolutely imperative that wireless connections are secure and if you don't use wireless switch it off.
